Recognition of foreign qualification on purpose of entrepreneurship

The assessment of your professional competence is required if the trade in which you intend to start your business belongs to the regulated trades.

What is a regulated trade?

Act No 455/1991 Coll., the Trade Licensing Act.

A regulated trade is such a trade where legal regulations set the specific requirements - professional and other competences - without which the performance of the trade is not allowed. It can be requirements such as education, professional experience, proof of integrity, health condition, etc. By professional competence is meant the education and professional experience. Health and integrity belong to the other competences, etc.

The Trade Licensing Act makes a distinction between 4 types of trade:

  • Unqualified trades
  • Vocational trades
  • Professional trades
  • Permitted trades

Regulated trades are Vocational trades, Professional trades and Permitted trades.

How do I find out if my trade is regulated?

The list of regulated (vocational, professional and permitted) trades is included in the Annex of the Trade Licensing Act. The list of vocational trades is in Annex No 1, the list of professional trades in Annex No 2, the list of permitted trades in Annex No 3.

My trade is regulated. How do I prove my professional competence?
If your trade is regulated, the assessment of your professional competence may vary depending on whether or not the Act No 179/2006 Coll., on the Recognition of Further Education Results, applies to you.

Does the Act on the Recognition of Professional Qualifications apply to me?

The Act on the Recognition of Professional Qualification applies to you if you meet two following conditions:

I. If you are:

  1. 1. a national of the EU member state, European Economic Area or Swiss Confederation or a family member of such a national, or
  2. 2. a foreign national who may permanently reside in the territory of the Czech Republic based on a permit for a permanent residence or a family member of such a national, or
  3. 3. a third country national who may be a long-term resident in the European Economic Area, Swiss Confederation or an EU country, or you reside in a member state of EU on the purpose of scientific research or if you are a family member of a third country national who is a long-term resident in a European Economic Area, EU member state or the Swiss Confederation or who has a long term residence in an EU member state on the purpose of scientific research ,and if you have a long-term residence in the territory of the Czech republic or
  4. 4. a holder of asylum or subsidiary protection in the Czech Republic or a family member of such a holder with long-term residence in the territory of the Czech Republic or
  5. 5. a third country national with a residence permit on purpose of study in the territory of the Czech Republic or other member state of EU, on purpose of study exchanges, unpaid internship or volunteer service or
  6. 6. a third country national who is victim to human trafficking or has been the subject of an action to facilitate illegal immigration and have been granted residence in the territory of the Czech Republic or other member state of EU on this purpose or
  7. 7. you are holder of a blue card.

II. You obtained your professional qualification (education) in a member state of the EU, EEA or Swiss Confederation.

You will proceed in accordance to the Act on the Recognition of Professional Qualifications if the Act applies to you.

Recognition of professional and other qualification for purpose of entrepreneurship in accordance to the Act on the Recognition of Professional Qualifications.

The procedure of recognition of professional qualification in accordance to the Act on the Recognition of Professional Qualifications is the same for all vocational trades. In the case of professional and permitted trades, the procedure is different for each trade.

If the Act on Recognition of Professional Qualifications doesn't apply to you, you will need to demonstrate your professional competence according to the requirements of the specific regulated profession (trade). If documents of education are required, you will need to have them recognized.

Recognition of professional and other qualification on the purpose of the entrepreneurship in specific situations.

The procedure for recognition of professional qualifications is the same for vocational trades. In the case of professional and permitted trades the procedure is different for each trade.
